Welcome to the first edition of the Family Law Newsletter. At Russell Kennedy we are conscious of the effect Family Law matters have on people so we have developed a newsletter to provide practical information on topical issues, case summaries and judgements to help you.

CHANGES TO THE LAW RELATING TO DE FACTO RELATIONSHIPS

The laws relating to de facto relationships are currently within the jurisdiction of the State legislation and State courts. 

Due to the referral of powers by most States and Territories to the Commonwealth, this area of the law will be the subject of significant change in the near future.  It is believed that the Bill will be tabled in Federal Parliament later this year and it appears to have the support of the major parties.

SHARED PARENTAL RESPONSIBILITY AND DECISION MAKING

On 1 July 2006 the Family Law Amendment (Shared Parental Responsibility) Act 2006 (“the Act”) came into effect, reforming the existing Family Law Act 1975.

The Act has introduced a presumption of “equal shared parental responsibility”.  This means that both parents have an equal role in making decisions about “major long term issues”.  That is, the decision must be made jointly.
